Summary:

Determination of membership in the bargaining unit - Tour Shop Technician, Tour Technician, Security Technician, Technical Tour Co-ordinator and Network Technician employed in the Tour Group Unit at the Privy Council Office - Electronics Group bargaining unit - Section 34 of the Public Service Staff Relations Act - the International Brotherhood of Electrical Workers, Local 2228 (IBEW) had been certified as the bargaining agent of the Electronics Group bargaining unit: 142-2-325, (1999) 35 PSSRB Summaries 5 - it applied to have included in the Electronics Group bargaining unit the network technician employed in the Tour Group Unit at the Privy Council Office - it also applied to have included in the Electronics Group bargaining unit the other technicians and co-ordinator (employees) - the network technician was part of a bargaining unit comprised of "all employees of the Employer in the Computer Systems Group", for which the Professional Institute of the Public Service of Canada (PIPSC) had been certified as the bargaining agent: 142-2-344, (1999) 35 PSSRB Summaries 15 - the PIPSC and the employer conceded that the Network Technician position should be included in the Electronics Group bargaining unit - the employees were part of a bargaining unit comprised of "all employees of the Employer in the Technical Services Group", for which the Public Service Alliance of Canada (PSAC) had been certified as the bargaining agent: 142-2-339, (1999) 35 PSSRB Summaries 12 - the PSAC and the employer opposed the IBEW's application - the IBEW asserted that the employees were performing duties which placed them in the Electronics Group bargaining unit - the employer and the PSAC responded that the duties performed by the employees more closely resembled those identified in the Technical Services Group definition - the Board found that the Technical Services Group definition better encompassed the pith and substance of the employees' duties - the Board found that the Network Technician position was included in the Electronics Group bargaining unit. Application allowed in part.
