Summary:

Complaint - Failure to give effect to an adjudication decision - Paragraph 23(1)(c) of the Public Service Staff Relations Act - in an earlier decision, an adjudicator had allowed a grievance filed by the complainant with respect to a financial penalty, because the employer had conceded the grievance at the hearing: 2000 PSSRB 53 (166-2-29532), (2000) 37 PSSRB Summaries 19 - that financial penalty had been imposed following the employer's investigation of a harassment complaint filed against the complainant - at the adjudication hearing, the employer had committed to remove any record of the harassment complaint and financial penalty from any of its files - the complainant complained that some of the employer's files still contained a record of the employer's findings on the harassment complaint and of the financial penalty which ensued - the employer responded that the complainant's personnel file did not contain any record of the financial penalty - it added that it had an obligation to keep such record in some other files - the complainant submitted that he would be satisfied if a copy of decision 2000 PSSRB 53 was put on those files - the employer responded that it was disposed to do so - the Board ordered that the employer place a copy of decision 2000 PSSRB 53, reflecting the employer's concession of the complainant's grievance, on all employer files relating to the events leading up to and following the financial penalty, including the harassment complaint files. Complaint allowed.
