Summary:

Council of employee organizations - Application under section 49 of the Public Service Staff Relations Act - Merger of one constituent member of council with another employee organization - on November 10, 1967, the Board certified the Council of Graphic Arts Unions of the Public Service of Canada (CGAU) as bargaining agent for all employees of Treasury Board in the printing operations group, other than employees whose duties included the supervision of other employees in that occupational group: 146-2-16 - on May 6, 1994, the Board certified the CGAU as bargaining agent for all employees of the Canada Communication Group performing printing production and other related operations job functions: 142-28-302 to 310 and 125-28-62, (1994) 25 PSSRB Decisions 1 and 3 - at the time of the last certification the CGAU consisted of three constituent employee organizations including the Communications Workers of America, Local 102, which subsequently merged with another employee organization resulting in the creation of the Communications, Energy and Paperworkers Union of Canada, Local 102 (CEPU) - CGAU sought a declaration pursuant to section 49 of the Public Service Staff Relations Act (PSSRA) that, as reconstituted, it retained all the rights, privileges and duties held by it prior to the merger - Board found that the CEPU was an employee organization as defined in section 2 of the PSSRA and that the CEPU had granted authority to the CGAU to act for the CEPU in matters of collective bargaining with the employers and in administering any applicable collective agreements - the Board also found that the CEPU had replaced the Communications Workers of America, Local 102, as a constituent member of the CGAU - accordingly, the Board declared and determined that the CGAU, consisting of the CEPU and two other employee organizations, was the bargaining agent for the two afore-mentioned bargaining units - furthermore, the Board declared that the CGAU, as reconstituted, retained all the rights, privileges and duties of the CGAU, as previously constituted, and was party to any applicable collective agreement. Application allowed.
