Summary:

Amendment to designation of positions having safety or security duties - Subsection 78.1(6) of the Public Service Staff Relations Act (PSSRA) - Non-Supervisory Printing Services Group - in an earlier decision, the Board had designated, pursuant to subsection 78.1(6) of the PSSRA, the positions in the Printing Operations Group bargaining unit which the parties had agreed have safety or security duties: (181-2-442), (1998) 34 PSSRB Summaries 42 - in another decision, the Board amended the description of the bargaining unit, which is now comprised of all employees in the new Non-Supervisory Printing Services Group: (142-2-334), (1999) 35 PSSRB Summaries 9 - subsequently, the employer advised the Board that some positions in the bargaining unit had been abolished - accordingly, the Board revoked the designation of those positions that no longer appeared on the list and the Forms 13 that had been issued in relation to them. Designations revoked.

[1]   In Council of Graphic Arts Unions of the Public Service of Canada v. Treasury Board, (181–2-442, July 24, 1998), the Board designated positions in the Printing Operations Group bargaining unit pursuant to subsection 78.1(6) of the Public Service Staff Relations Act (Act).  Diskette PR1.xls (the “old diskette”) contains the list of all of the positions which the parties agreed had safety or security duties as of that date.

[2]   In Council of Graphic Arts Unions of the Public Service of Canada v. Treasury Board, (142–2-334, June 2, 1999), the Board amended the description of the bargaining unit to refer to “All employees of the Employer in the Non-Supervisory Printing Services Group as defined in Part I of the Canada Gazette of March 27, 1999” and confirmed the Council of Graphic Arts Unions of the Public Service of Canada as its bargaining agent.

[3]   On June 13, 2001, the employer advised the Board that it had abolished some positions in the Printing Operations Group.  Enclosed with the employer’s letter was a new diskette bearing identification Table 23–1.xls (the “new diskette”).  The employer advised the Board that the bargaining agent has been provided with a printout of this new diskette.  This new diskette is accepted by the Board as an amendment to the old diskette and is contained in the Board file.  Accordingly, this new diskette contains the list of all of the positions which the parties now agree have safety or security duties.

[4]   On the basis of the agreement of the parties, the Board hereby revokes the designation of those positions that appeared on the old diskette and that do not appear on the new diskette.  The Board also revokes the Forms 13 issued for those positions and directs the employer to return forthwith the Forms 13 that have not been distributed to the employees in those positions.  Furthermore, the employer is to make every reasonable effort to obtain any Forms 13 that have been so distributed to employees in those positions.  The bargaining agent is to cooperate in this regard.  The Board will destroy the Forms 13 when returned by the employer.
