Request before the Board

1 In Association of Justice Counsel et al. v. Treasury Board et al., 2006 PSLRB 45, the Public Service Labour Relations Board ("the Board") certified the Association of Justice Counsel ("the respondent") as the bargaining agent for a bargaining unit comprising "…all lawyers in the LA group for which the Treasury Board is the employer who are not excluded from collective bargaining by law or determination of the Board…" ("the bargaining unit").

2 In Treasury Board v. Association of Justice Counsel, 2007 PSLRB 44, the Board made an order declaring that some positions in the bargaining unit are managerial or confidential positions.

3 On May 22, 2007, the Treasury Board ("the applicant") filed an application under section 43 of the Public Service Labour Relations Act for the Boardto review decision 2007 PSLRB 44. The applicant alleged that some of the information that the parties had provided in support of the original joint application that led to decision 2007 PSLRB 44 was in error. The applicant requested that the position numbers of some positions declared managerial or confidential in decision 2007 PSLRB 44 be amended.

4 On June 8, 2007, the respondent consented to the amendments requested by the applicant.

5 Under those circumstances, the Board grants the applicant's request.

6 For all of the above reasons, the Board makes the following order:

7 The annex to decision 2007 PSLRB 44 is amended as specified in the annex to this decision.
