Request before the Board

1 On June 20, 2007, the Treasury Board ("the applicant") applied for the exclusion of a managerial or confidential position within the Applied Science and Patent Examination Group bargaining unit. The bargaining agent, the Professional Institute of the Public Service of Canada ("the respondent"), did not object to the exclusion of position 520 (Director).

2 On July 26, 2007, the Public Service Labour Relations Board ("the Board") made an order (PSLRB File No. 572-02-740) declaring that position 520, identified in the annex to the order, was a managerial or confidential position.

3 On August 2, 2007, the applicant filed an application under section 43 of the Public Service Labour Relations Act for the Board to review its July 26, 2007, order (PSLRB File No. 572-02-740). The applicant stated that the position number used to identify the Director position should have been 45407, not 520. The applicant requested that the position declared managerial or confidential in the July 26, 2007, order have its position number amended.

4 On August 2, 2007, the respondent consented to the requested amendment.

5 Under those circumstances, the Board grants the applicant's request.

6 For all of the above reasons, the Board makes the following order:

7 The annex to the July 26, 2007 order (PSLRB File No. 572-02-740), is amended as specified in the annex to this decision.
