REASONS FOR DECISION
filed April 2, 11 and 22 and May 1, 2 and 6, 2008.
Request before the Board
1 On April 2, 2008, the Treasury Board (“the applicant”) applied for the exclusion of 55 managerial or confidential positions within the Program and Administrative Services (PA) Group, including position number 80100-33050 (at the Correctional Service of Canada, AS-07, held by N. Gerl in Abbotsford, British Colombia). The bargaining agent, the Public Service Alliance of Canada (“the respondent”), did not object to the exclusion of position number 80100-33050.
2 On April 11, 2008, the Public Service Labour Relations Board (“the Board”) declared 11 positions to be managerial or confidential (PSLRB File No. 572-02-1076), one of which was position number 80100-33050.
3 On May 2, 2008, the applicant requested that the Board exercise its powers under section 43 of the Public Service Labour Relations Act to review its order dated April 11, 2008, and by doing so declare position number 80100-33050 to be a managerial or confidential position effective March 31, 2008, and not April 11, 2008.
4 The respondent consented to the requested amendment.
5 Under the circumstances, the Board grants the applicant’s request.
6 For all of the above reasons, the Board makes the following order:

7 The Board’s order PSLRB File No. 572-02-1076, dated April 11, 2008, is amended only to declare that position number 80100-33050, in the PA group is a managerial or confidential position effective March 31, 2008.
