Request before the Board

1 On October 21, 2008, the Canada Revenue Agency (“the applicant”) applied for the exclusion of two managerial and confidential positions within the Program Delivery and Administrative Services Group bargaining unit. The Public Service Alliance of Canada (“the respondent”) did not object to the exclusion of those positions, numbered 30006232 and 30005852.

2 On November 17, 2008, the Public Service Labour Relations Board (“the Board”) ordered (PSLRB File Nos. 572-34-1354 and 572-34-P1) that positions 30006232 and 30005852, as identified in the annex to the order, were managerial or confidential positions.

3 The applicant filed an application with the Board under section 43 of the Public Service Labour Relations Act on November 20, 2008, requesting that the Board review its November 17, 2008 order (PSLRB File Nos. 572-34-1354 and 572-34-P1). The applicant stated that the order identified the classifications of positions 30006232 and 30005852 as MG-06 rather than MG-05. Furthermore, the applicant requested that the group and level of the positions declared managerial or confidential in the November 17, 2008, order be amended.

4 On November 25, 2008, the respondent consented to the requested amendments.

5 Under those circumstances, the Board grants the applicant’s request.

6 For all of the above reasons, the Board makes the following order:

7 The annex to the November 17, 2008 order (PSLRB File Nos. 572-34-1354 and 572-34-P1) is amended as specified in the annex to this decision.
