Request before the Board

1 On February 16, 2010, the Public Service Labour Relations Board (“the Board”) ordered in PSLRB File Nos. 572-02-1824 and 572-02-A6 that position 33270 in the Architecture, Engineering and Land Survey (NR) Group bargaining unit, as identified in the annex to the order, was a managerial or confidential position.

2 On February 22, 2010, the Treasury Board (“the applicant”) filed an application with the Board under section 43 of the Public Service Labour Relations Act, enacted by section 2 of the Public Service Modernization Act, S.C. 2003, c. 22, requesting that the Board review its February 16, 2010 order. The applicant stated that the bargaining unit for position number 33270 should have been identified as the Research Group bargaining unit and not the Architecture, Engineering and Land Survey (NR) Group bargaining unit.

3 On February 23, 2010, the Professional Institute of the Public Service of Canada consented to the requested amendment.

4 Under those circumstances, the Board grants the applicant’s request.

5 For all of the above reasons, the Board makes the following order:

6 The annex to the February 16, 2010, order in PSLRB File Nos. 572-02-1824 and 572-02-A6 is amended with respect to position 33270 as specified in the annex to this decision.
