1 On August 16, 2007, an adjudicator of the Public Service Labour Relations Board (“the Board”) rendered a decision in the above-cited case, allowing the grievor’s grievance.

2 On July 16, 2008, the Federal Court allowed the application for judicial review of the adjudicator’s decision (Docket T-1607-07, 2008 FC 873). The Court issued a written judgment in which it stated its reasons and referred the case back to the Board with the direction to dismiss the grievance in accordance with the reasons for judgment. On December 23, 2009, the Federal Court of Appeal dismissed Mr. Demers’ appeal (2009 FCA 380).

3 In accordance with the Federal Court’s direction and its stated reasons, I make the following order:

4 The grievance that was the subject of Demers v. Deputy Head (Correctional Service of Canada), 2007 PSLRB 89, is now dismissed.
