TERMS OF REFERENCE



1 In a decision dated September 27, 2012 (Citation 2012 PSLRB 101), I established an arbitration board in the above-cited matter. The arbitration board was composed of Mr. Michael Bendel, chairperson, Mr. Joe Herbert, nominee for the bargaining agent and Mr. Jacques Sabourin, nominee for the employer.

2 In an e-mail dated December 13, 2012, Ms. Carol Piette, counsel for the employer informed the Public Service Labour Relations Board that Mr. Sabourin could no longer act as their nominee on the arbitration board.  Ms. Piette also requested that Mr. Sabourin be replaced by Mrs. Kathryn Butler Malette of Ottawa Ontario, Mrs. Butler Malette having already indicated her willingness and availability to act as the new nominee for the employer.

3 Accordingly, this will serve to confirm that the appointment of Mr. Jacques Sabourin as member is hereby rescinded.  This will also confirm that pursuant to section 48(1) of the Act, I hereby establish in this matter an arbitration board composed of the following members:

  • Mr. Michael Bendel, chairperson;
  • Mr. Joe Herbert; and
  • Mrs. Kathryn Butler Malette

4 Pursuant to section 52 of the Act, the matters on which the arbitration board shall render an arbitral award in this dispute remain those set out as outstanding in paragraph 5 of my previous decision of September 27, 2012 (Citation 2012 PSLRB 101).
