REASONS FOR DECISION
Matter before the Board
1 On April 17, 2009, the Public Service Labour Relations Board ("the Board") made an order in PSLRB File No. 572-02-1520 declaring that the positions within the Program and Administrative Services Group bargaining unit that were identified in the annex to that order were managerial or confidential positions. Position 30220228 was identified in that annex.
2 On July 13, 2012, the Treasury Board (“the employer”) filed an application with the Board under section 43 of the Public Service Labour Relations Act (“the Act”), requesting that the Board review its April 17, 2009 order. The employer asked for a declaration that position 30220228 is no longer a managerial or confidential position within the meaning of subsection 2(1) of the Act and for an order revoking the order that excluded that position. On July 13, 2012, the Public Service Alliance of Canada consented to the application.
3 For all of the above reasons, the Board makes the following order:

4 The Board declares that position 30220228 is no longer a managerial or confidential position within the meaning of subsection 2(1) of the Act.
5 The annex to the Board’s order of April 17, 2009 in PSLRB File No. 572-02-1250 is hereby amended to delete any reference to position 30220228.
