SUPPLEMENTARY TERMS OF REFERENCE

Issued on the basis of written submission,
dated February 27 and March 8, 2013.

1 In a decision dated January 18, 2013 (2013 PSLRB 5), I established an arbitration board in the above matter.  The arbitration board was composed of Mr. Michel Picher, chairperson, Mr. Phillip Hunt, nominee for the Association of Canadian Financial Officers (“bargaining agent”) and Mr. Anthony Boettger, nominee for the Treasury Board of Canada (“employer”).

2 In a letter dated February 27, 2012, Mr. Barry Fennessy, on behalf of the employer, informed the Public Service Labour Relations Board that Mr. Boettger could no longer participate in this process, effective immediately.

3 In a letter dated March 8, 2013, Mr. Fennessy informed the Board that they wished to nominate Mr. Ryan Wood of Toronto, Ontario, as the new nominee for the employer.

4 Accordingly, pursuant to sections 139 and 143 of the Public Service Labour Relations Act (the “Act”), I confirm that the appointment of Mr. Boettger as member of the arbitration board dated January 17, 2013 is hereby rescinded.  I also confirm Mr. Ryan Wood as nominee for the employer and member of the arbitration board.  Therefore, pursuant to sections 135 to 159 of the Act, I hereby establish in this matter an arbitration board composed of the following members:

Mr. Michel Picher, chairperson;
Mr. Phillip Hunt and
Mr. Ryan Wood, members.

5 Pursuant to subsection 144 of the Act, the matters in dispute on which the arbitration board shall render an arbitral award are those set out in paragraph 5 of my previous decision of January 18, 2013 (2013 PSLRB 5).

6 Should any jurisdictional question arise during the course of the hearing as to the inclusion of a matter in these terms of reference, that question must be submitted without delay to the Chairperson of the Public Service Labour Relations Board, who is, according to subsection 144(1) of the Act, the only person authorized to make such a determination.
