REASONS FOR DECISION

Application before the Board

1 On April 22, 2014, the Treasury Board ("the applicant") applied for an order declaring that positions in the LA Group bargaining unit are managerial or confidential pursuant to section 71 of the Public Service Labour Relations Act (PSLRA). Positions 21888, 21890, 21892, 21893 and 21894 formed part of that application.

2 On May 28, 2014, the Public Service Labour Relations Board ("the Board") made an order (PSLRB File Nos. 572-02-2981, 572-02-L2) declaring that the positions identified in the annex to that order are managerial or confidential positions. Positions 21888, 21890, 21892, 21893 and 21894 were identified in that annex.

3 The applicant filed an application with the Board under section 43 of the PSLRA on June 6, 2014, advising the Board that an erroneous annex was submitted electronically on April 22, 2014. The applicant stated that the annex identified the department for the five positions as Justice Canada (Department of Justice) rather than the Public Prosecution Service of Canada (Office of the Director of Public Prosecutions). Furthermore, the applicant requested that the five positions declared managerial or confidential in the May 28, 2014, order (PSLRB File Nos. 572-02-2981, 572-02-L2) be amended.

4 On June 12, 2014, the Association of Justice Counsel indicated that it had no objection to the applicant’s requested amendment.

5 Under those circumstances, the Board grants the applicant’s request.

6 For all of the above reasons, the Board makes the following order:

7 The annex to the May 28, 2014, order (PSLRB File Nos. 572-02-2981, 572-02-L2) is amended as specified in the annex to this decision.
