Summary:

Suspension (7 days) - Misconduct - the grievor, a correctional officer, was stopped by police and charged with having car windows that were too heavily tinted - when he appeared before a Justice of the Peace to contest the charge, the arresting officer felt the grievor was disrespectful of the "court" in not removing his cap and in being overly aggressive in cross-examination - the employer suspended the grievor for wearing his uniform to court and because he had been aggressive before the Justice of the Peace - the evidence established that the hearing was adjourned when the grievor wore his cap and that he was wearing his uniform because he was on his way to work - there was also no evidence to establish that the grievor had acted improperly before the Justice of the Peace - there was no evidence to justify the discipline imposed. Grievance allowed.
