Summary:

Termination (non-disciplinary) - Procedure - Abandonment of grievance - the grievor filed a grievance against the termination of his employment for reason of medical incapacity - his bargaining agent requested and obtained a postponement of the hearing and informed the Board that it would not be representing the grievor - the grievor later requested and obtained a second postponement of the hearing because he was allegedly medically unable to represent himself and financially unable to retain legal representation - at the hearing, the grievor requested and obtained, in order to subpoena two witnesses who were not available at that time, an adjournment after the employer had presented its case - the grievor later requested an extension of the adjournment, as he was allegedly medically unable to represent himself and financially unable to attend the hearing, retain legal representation and subpoena witnesses - he informed the Board that he would provide a letter from his physician - the Board informed the grievor that it would grant an extension of adjournment, provided that the grievor present a medical certificate by a specific date - the medical certificate was so presented - thereafter, the Board wrote to the grievor on three occasions to ascertain a date for the continuation of the hearing - none of these letters received an answer - as of the date of the decision, there had been no further communication from the grievor - the adjudicator found that the grievor had abandoned his grievance. Grievance denied.
