Decision Information

Summary:

Workforce Adjustment Directive (WFAD) - Reasonable job offer - Offer to relocate with position - Early departure incentive - the grievor's position had been transferred from Esquimalt, British Columbia to Halifax, Nova Scotia - the grievor chose not to relocate with his position, for both personal and professional reasons - the employer declared him a surplus employee and informed him that, should no other employment opportunity in the Public Service be available to him, the grievor would be reoffered to relocate with his position to Halifax, at which time it would be considered a reasonable job offer under the WFAD - the grievor later requested an early departure incentive - the employer denied the request because the grievor would either be presented with a reasonable job offer or be reoffered to relocate with his position - the adjudicator found that, in the circumstances, reoffering the grievor to relocate with his position, were no other reasonable job offers available to him, constituted a reasonable job offer under the WFAD. Grievance denied. Case cited: Attorney General of Canada v. Edwards (18 January 1999), T-105-98 (F.C.T.D.).
