[1]      The parties have reached a settlement of this matter, as reflected in a Memorandum of Understanding, which they have signed and filed with the Board.

[2]      To give effect to this Memorandum of Understanding, the parties have filed a Consent in writing to an order of the Board; the Board therefore orders as follows:

(a)     The Employer shall pay the Grievor a lump sum of $78,000, less normal source deductions, in lieu of continuing to pay the Grievor acting pay at the PG-5 level for the period October 28 2002 until March 1, 2009. This sum is the equivalent of her acting pay at current rates of pay for this period;

(b)     The Employer shall make every reasonable effort to have the appropriate authorities reinstate the Grievor's Canada Pension Plan contributions for the year 2000. In the event the Grievor is not granted contributor status for all or a portion of the year 2000, the parties shall undertake to determine appropriate compensation in lieu of contributor status. The Adjudicator shall remain seized in the event the parties are unable to agree on the appropriate compensation;

(c)     The Grievor and the employer shall in all other respects comply with the terms of the settlement entered into by them.
