Summary:

Compensation - Sick leave - Stress in the workplace - Timeliness - the grievor's physician was of the view that the grievor could return to work in April 1991 - however, she preferred not to return to the same department - in July 1993, the employer offered her a position in the same department, but in another work unit - she accepted the offer and returned to work in August 1993 - the grievor filed a grievance in 1998 to obtain payment of her salary and benefits from April 1991 to August 1993 - the employer argued that the grievance was untimely - the grievor maintained that she could not have filed a grievance before having exhausted her recourse to disability insurance and pension available to her - the adjudicator found that she could have filed her grievance within the prescribed time frame. Grievance denied.
