Decision Information

Summary:

Suspension (1 day) - Insubordination - the grievor made an allegation of improper behaviour on the part of her superior - the superior imposed a written reprimand upon the grievor when she failed to provide substantiating details in support of her allegation despite having been ordered to do so by the superior - the superior again ordered the grievor to provide the substantiating details in support of her allegation - when the grievor was unable to do so, the superior imposed a one-day suspension upon her - the grievor claimed that this constituted double jeopardy as she was being penalized twice for the same act of misconduct - the adjudicator found that there was no double jeopardy as there were two distinct acts of misconduct on the grievor's part. Grievance denied.
