[1]    This reference to adjudication was filed with the Board on July 2, 2002, by the Public Service Alliance of Canada, the bargaining agent, on behalf of the grievor, Ms. Marilee Nowgesic. This grievance concerns a discharge.

[2]    The Public Service Alliance of Canada wrote to the Board on February 25, 2004, to inform the Board that, despite numerous efforts, the bargaining agent was unable to contact the grievor. The bargaining agent also informed the Board that it was withdrawing its support of the grievance.

[3]    The Board wrote to Ms. Nowgesic on March 17, 2004, at her last known address on record, informing her that the bargaining agent was no longer representing her in this matter and requesting that she inform the Board by March 31, 2004, whether she wished to proceed with the reference to adjudication. No response to the March 17, 2004 letter was received; the letter was returned to the Board as unclaimed on April 15, 2004.

[4]    The Board again wrote to Ms. Nowgesic on April 26, 2004, requesting her to inform the Board by May 10, 2004, whether she wished to proceed with her grievance. No response to the April 26, 2004 letter was received; the letter was returned to the Board as unclaimed on May 19, 2004.

[5]    The Board wrote to the grievor on June 21, 2004, advising her that failure to inform the Board by July 9, 2004, whether she wished to proceed with her grievance might result in the Board closing this file without further notice. No response to the June 21, 2004 letter was received, nor was the letter returned to the Board as unclaimed.

[6]    Under the circumstances, I am satisfied that the grievor does not wish to pursue her grievance. Accordingly, I direct that the proceedings are terminated and the file closed.
