Summary:

Amalgamation of bargaining units - Description of bargaining unit - Confirmation of certification - Subsection 103(2) of the Public Service Reform Act (PSRA) - Audit, Commerce and Purchasing Group - pursuant to section 102 of the PSRA, the Treasury Board amended the specification and definition of the Purchasing and Supply Subgroup of the General Services Group - pursuant to section 101 of the PSRA, the Treasury Board specified and defined the occupational group known as the Audit, Commerce and Purchasing Group - immediately prior to this, the Professional Institute of the Public Service of Canada was the bargaining agent certified for the Purchasing and Supply Subgroup of the General Services Group bargaining unit, the Auditing Group bargaining unit and the Commerce Group bargaining unit, which are now covered by the new Audit, Commerce and Purchasing Group - pursuant to subsection 103(2) of the PSRA, the Board amalgamated these bargaining units into a new one, described as the Audit, Commerce and Purchasing Group bargaining unit - the bargaining agent's certifications had not been revoked under the Public Service Staff Relations Act and have been continued by virtue of subsection 103(1) of the PSRA - the Board confirmed the certification of the bargaining agent for the new bargaining unit. Bargaining units amalgamated. New bargaining unit described. Certification confirmed.

        THE RESOLUTION OF DISPUTES

[1]      In decision Professional Institute of the Public Service of Canada v. Treasury Board (142-2-343), June 16, 1999, the Board confirmed the Professional Institute of the Public Service of Canada (bargaining agent) as bargaining agent for the following bargaining unit (bargaining unit):

All employees of the employer in the Audit, Commerce and Purchasing Group as defined in Part I of the Canada Gazette of March 27, 1999.

[2]      On June 21, 1999, the bargaining agent filed with the Board, in accordance with section 61 of the P.S.S.R.B. Regulations and Rules of Procedure, 1993 (Regulations), a specification which stated that the process for resolution of any dispute to which it may be a party in respect of the bargaining unit, shall be by referral of the dispute to a conciliation board.

[3]      On July 5, 1999, pursuant to subsection 38(1) of the Public Service Staff Relations Act (the Act), the Board recorded as part of the certification of the Professional Institute of the Public Service of Canada for the bargaining unit described in paragraph 1, hereof, that the process for the resolution of any dispute to which the bargaining agent could henceforth be a party in respect of such bargaining unit shall be by referral of the dispute to a conciliation board.

[4]      Subsequently, on March 21, 2003, the bargaining agent filed with the Board, in accordance with section 62 of the Regulations, an application for an alteration, which stated that the process for resolution of any dispute to which it may be a party in respect of the bargaining unit should be arbitration.

[5]      Pursuant to section 39 of the Act, the Board hereby records that the process for the resolution of any dispute to which the bargaining agent may be a party in respect of the bargaining unit shall be by referral to arbitration.

[6]      The process so recorded shall be the process applicable to the bargaining unit for the resolution of all disputes from the time on which any notice to bargain collectively in respect of the bargaining unit is given next following March 21, 2003, and thereafter until the process is again altered in accordance with section 39 of the Act.
