Summary:

Grievance in principle - Union dues check-off - Pay levels of employees in the bargaining unit - Personal information - Correctional Service Group - the bargaining agent claimed that the collective agreement required the employer to provide him with information concerning the pay levels of employees in the bargaining unit - the employer acknowledged that the bargaining agent needed this information to satisfy himself of the accuracy of the amounts withheld from the employees' pay as union dues - the Office of the Privacy Commissioner was of the opinion that disclosure of this information was permissible under the Privacy Act, provided that the bargaining agent took steps to ensure its protection - the employer sought an order from the Board confirming that providing this information was required - the Board concluded that the information in question was essential in order to determine the amount of the union dues and that the employer must provide this information to the bargaining agent under the collective agreement. Grievance allowed.
