Summary:

Decision review - Appropriate bargaining unit - Section 27 of the Public Service Staff Relations Act - in an earlier decision, the Board had certified the Hospitality and Service Trade Union, Local 261 as bargaining agent for all employees of the employer"at the National Defence Headquarters employed in the cafeteria, save and except persons above the rank of supervisor, office and clerical staff": 142-18-320; (1997) 32 PSSRB Decisions 2 - the bargaining agent applied for a review of the definition of the bargaining unit, to include four employees working in a satellite retail operation within National Defence Headquarters - these employees had not been included through oversight - the employer was prepared to consent to the application, provided that the Board was satisfied that it was the wish of the four employees in question to be included in the bargaining unit - the Board requested the parties to post a number of copies of a"Notice to Employees of Application for Request for Review" where they would most likely come to the attention of the four employees - the Notice stated that any employee could oppose the application and laid out the procedure for doing so - no statement expressing opposition to the application was filed with the Board - the Board was satisfied that the four additional employees should be included in the existing bargaining unit, and amended the definition of the bargaining unit accordingly. Application allowed.
