Decision Information

Summary:

Decision review - Unfair labour practice - Section 27 of the Public Service Staff Relations Act (PSSRA) - in an earlier decision, the Board concluded that, in light of sections 8, 9 and 23 of the PSSRA, the applicant had no standing to file a complaint under section 23 of the PSSRA against an employer representative alleging interference in the representation the applicant would have liked to have received from his bargaining agent during a disciplinary investigation: (161-2-855); (1998) 34 PSSRB Decisions 4 - the applicant applied for review of that decision - the Board found that the applicant was not alleging a change in circumstances, nor attempting to present new evidence or arguments that could not reasonably have been presented at the original hearing - the Board further found that there were no compelling reasons for review. Application dismissed. Case cited: Public Service Alliance of Canada and Treasury Board (125-2-41).
