Decision review - Section 27 of the Public Service Staff Relations Act (PSSRA) - Modification to the composition of a council of employee organizations - in a previous decision, the Board had certified the Federal Government Dockyard Trades and Labour Council East (Council) as the bargaining agent for what is now known as the Ship Repair-East Group bargaining unit: August 20, 1976 (146-2-161), as amended on October 13, 1976 (146-2-161), April 16, 1981 (125-2-21), February 1, 1988 (146-2-278); (1988) 13 PSSRB Decisions 5, April 30, 1993 (125-2-56); (1993) 23 PSSRB Decisions 1 and May 20, 1999 (142-2-330); (1999) 35 PSSRB Decisions 7 - the Council applied to have its composition amended by adding the International Brotherhood of Electrical Workers, Local 1131 (IBEW 1131) for the purpose of representing employees represented up to then by the International Brotherhood of Electrical Workers, Local 1133 (IBEW 1133), another of the Council's constituent employee organizations - IBEW 1133 consented to this amendment - the employer did not oppose the Council's application - the Board was satisfied that IBEW 1131 was an employee organization within the meaning of subsection 2(1) of the PSSRA and that it had vested appropriate authority in the Council to enable it to discharge the duties and responsibilities of a bargaining agent - the Board therefore replaced the list of the Council's constituent employee organizations with a new one including IBEW 1131. Application allowed.
