The bargaining agent made an application to determine whether certain employees who work in the Information Services Directorate should be classified as members of the Technical group instead of the unrepresented Administration group and thus included in the bargaining unit represented by the bargaining agent – the Board found that the group definition should be given a static interpretation based on the context in which the employer established its classification plan – the Board also determined that the fact that positions inside and outside the bargaining unit were recruited together was not relevant – the Board concluded that all three positions in question are best fitted to the Administration group, given the specialized body of knowledge required as well as their advisory and discretionary duties.
