Summary:

On May 31, 2019, the complainant made a complaint against the Public Service Alliance of Canada (PSAC) in which she alleged that it had breached its duty of fair representation – the respondent denied the allegations and raised a preliminary objection – it submitted that the complainant failed to make an arguable case and requested that the complaint be dismissed without a hearing – after the Board examined the complaint and the submissions, it found that the complainant had demonstrated an arguable case related to the allegations that the PSAC violated the Public Sector Labour Relations Act (S.C. 2003, c.22, s.2), with respect to her allegations about the conduct of Ms. Koo, a Union of National Employees labour relations officer; the self-representation agreement and its alleged impact on the outcome of her grievance; and the PSAC’s refusal to represent her on subsequent grievances – as such, the Board will hear the merits of those allegations at a hearing – the respondent objected to the timeliness of the complainant’s allegation about the PSAC’s failure to advise her of other complaints against her – the Board decided to hear the issue of timeliness relating to that allegation at the hearing.
