Summary:

The employer objected to the referral of the grievance to adjudication as the grievance had been filed beyond the time limit (25 days) in the relevant collective agreement – the bargaining agent argued that since the employer did not respond at the final level within the deadline, it could not raise an objection based on timeliness – the Board was satisfied that the bargaining agent had agreed to an extension for the employer’s final-level reply – the bargaining agent provided no explanation for the delay presenting the grievance at the first level – absent any explanation, there was no reason for the Board to consider granting an extension – therefore, the employer’s objection to timeliness was allowed.
