Summary:

In the context of his complaint challenging one appointment that was made in an advertised appointment process, the complainant requested an OPI related to other appointments that he had not challenged. He requested different information, including the assessments of all candidates for all competencies at the reference stage of the appointment process and any communication at that stage about his application. The respondent objected to the request for information about other appointments, arguing that the complaint was limited to only one appointment. The Board found that the requested information was arguably relevant to the complainant’s allegations of discrimination and abuse of authority. While he could not seek recourse to challenge the other appointments made through the appointment process, he could request information about other candidates and appointees for the purpose of proving the differential treatment or discrimination in the appointment process that was the subject of his complaint.
