The grievor grieved the employer’s refusal to reimburse him for damages linked to pay issues with Phoenix in 2016. He also made a claim for the same damages through the specialized process. He asked the Board to hold this grievance in abeyance, pending the outcome of the specialized process. The employer asked the Board to deem the grievance withdrawn since clause 39 of the MOA required the bargaining agent to withdraw all grievances related to Phoenix damages. The Board found that the grievor’s alleged losses fell within the word “damages” in clause 39 of the MOA. The MOA prohibited the grievor from keeping his grievance before the Board, so it had to be withdrawn.
