Summary:

Two duty-of-fair-representation complaints were made against the Public Service Alliance of Canada (PSAC). The complainant also made two motions, the first that the Board Member recuse himself from this case, and the second to order that a registry officer not be involved in her case and that PSAC’s counsel be struck from the file. PSAC responded by asking that the complaints be dismissed without an oral hearing. The Board dismissed the complainant’s motions once it found that she did not set out the grounds that would have established a reasonable apprehension of bias and that she failed to present a basis for the Board’s jurisdiction to have PSAC’s counsel struck from the file. It also dismissed the two complaints. For the first complaint, it deemed that the complainant did not make out an arguable case that PSAC acted in a way that was discriminatory or in bad faith. It found that the second complaint was untimely, and it had no jurisdiction to consider it further.
